Terms of Service

1. What KickoffPools is
KickoffPools ("the Service," "we") is an entertainment and organization tool for running score-tracking games — like squares boards and pick'em pools — with friends, family, and coworkers. By using the Service you agree to these terms.
2. What KickoffPools is not
The Service is not a gambling service, sportsbook, lottery, sweepstakes, or contest operator, and it is not a payment service. The Service does not and will not:
- collect, hold, transfer, or pay out money or anything of value in connection with any pool;
- charge for entry into any pool or condition winning on any payment;
- award prizes of any kind — pool results confer bragging rights only;
- process, facilitate, or track wagers, stakes, buy-ins, pots, or payouts.
Any arrangement between participants outside the Service is solely between those participants. You are responsible for knowing and following the laws that apply where you live, and you agree not to use the Service to facilitate unlawful activity of any kind, including unlawful gambling. We may remove pools or accounts that we reasonably believe violate this section.
3. Eligibility
You must be at least 18 years old to use the Service. The Service is not directed to children, and we do not knowingly collect personal information from children under 13.
4. Accounts and links
Commissioners sign in with an email link; players participate through pool links without accounts. You are responsible for who you share links with. Commissioner links control a pool — keep them private. We may suspend accounts that abuse the Service (spam, scraping, harassment, or attempts to break these terms).
5. Your content
Names, pool names, and any images or text you add must be yours to use and must not be unlawful, infringing, hateful, or sexually explicit. You grant us a limited license to host and display that content so the Service works. We may remove content that violates this section. To report content or claimed infringement, email support@kickoffpools.com with the pool link and details; we respond to valid notices consistent with the DMCA.
6. Sports data and third parties
Scores and schedules come from third-party sources and may be delayed, incomplete, or wrong; commissioners can correct a pool's game data. Team names appear for identification only. KickoffPools is not affiliated with, endorsed by, or sponsored by any league or team.
7. The Service is provided "as is"
To the fullest extent permitted by law, the Service is provided without warranties of any kind, and we are not liable for indirect, incidental, special, consequential, or punitive damages, or for any dispute between participants. Our total liability for any claim is limited to $100 or the amount you paid us in the past 12 months, whichever is greater.
8. Changes and termination
We may update the Service and these terms; material changes will be posted here with a new date. You can stop using the Service at any time; we may suspend or end the Service or your access for violations of these terms.
9. Governing law
These terms are governed by the laws of the State of Florida, USA, without regard to conflict-of-law rules, and disputes will be resolved in the state or federal courts located in Florida.
